Omaha, Nebraska – A Honduran national has been sentenced in federal court after being convicted of illegally returning to the United States and unlawfully possessing a firearm.
United States Attorney Lesley A. Woods announced that Marlon Leiva-Orellana, of Honduras, was sentenced on June 30, 2026, in federal court in Omaha, Nebraska.
Chief United States District Judge Robert F. Rossiter, Jr. ordered Leiva-Orellana to serve 18 months in federal prison on both the illegal reentry and firearm convictions. The prison terms will run at the same time.
Federal officials noted that there is no parole in the federal prison system. After completing his sentence, Leiva-Orellana faces deportation to Honduras.
Authorities also emphasized that federal law prohibits individuals who are unlawfully present in the United States from possessing firearms.
Gun investigation led to additional immigration charge
According to court records, the case began on Jan. 13, 2026, when the Omaha Police Department responded to reports of gunfire near Camden Avenue in Omaha.
When officers arrived, they located a Nissan truck with North Carolina license plates. Investigators said Leiva-Orellana, who is also known as Marlon Leiva-Orellaha, was the only person inside the vehicle.
Officers observed a .22-caliber pistol inside the truck.
According to federal authorities, Leiva-Orellana admitted that he had fired the handgun. Officers arrested him at the scene.
During the investigation, authorities also discovered that Leiva-Orellana had previously been removed from the United States in November 2023.
Despite that removal, prosecutors said he returned to the country without lawful authorization, resulting in the federal illegal reentry charge in addition to the firearm offense.
The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Omaha Police Department, and United States Immigration and Customs Enforcement.
Following his prison sentence, federal authorities said Leiva-Orellana is expected to be removed from the United States and deported to his home country of Honduras.
